Several customers report their Milwaukee Switch Tank Pesticide Sprayers are leaking straight out of the box, leading to whatever substance is being used dripping outside of the assembly. Because the sprayer is designed to be carried on one’s back, this leakage issue potentially exposes customers to pesticides or other harmful chemicals dripping on their bodies, which could harm them. Customers may have claims for defective design, negligent design, and for damages arising from the use of the sprayers.
Milwaukee does not seem to be universally replacing the leaky tanks, and the warranty for Switch Tanks is shorter than other outdoor equipment, at 1 year, compared to 3 years for the general category under which the Switch Tanks fall. Milwaukee does not appear to have any arbitration or class action waivers.
Firefighters filed a similar lawsuit against their uniform manufacturers in February 2022, claiming that their protective gear exposes them to harmful chemicals, making some of them sick.
