Many customers are reporting their Vizio smart TVs interrupting their viewing experience by inserting banner ads over the TV content that they are viewing. Vizio did not advertise the televisions as containing ads, nor give customers the choice to opt into (or out of) advertisements of this sort. Indeed, Vizio is advertising this advertising platform to potential interested consumer-facing advertisers who may want to be featured in these intrusive banner advertisements.
Vizio’s terms of use for its smart TVs includes a binding arbitration agreement and class action waiver that both may be opted out of within 60 days in writing.
A similar lawsuit was filed against Samsung in 2015, regarding their insertion of unwanted ads into users’ personal media.
